Terms of Service

Please read these terms before using SEND FORGE. By creating an account or connecting a mailbox, you agree to them.

1. The service

SEND FORGE is an open-source application for storing leads, enriching them with AI, and running email outreach campaigns from sending accounts you own and connect (Resend, your own SMTP server, or Gmail). The source code is publicly available; you may inspect it, self-host it, and modify it under the terms of its open-source license. These terms apply to the hosted instance operated at this domain.

2. Accounts and workspaces

  • You must provide accurate information and keep your credentials secure.
  • Workspaces have roles (owner, admin, campaign manager, viewer). Owners and admins are responsible for who they invite and what those members do.
  • You are responsible for all activity under your account.
  • You must be at least 16 years old and able to enter a binding agreement.

3. Acceptable use

You agree not to use SEND FORGE to:

  • Send spam, unsolicited bulk email prohibited by law, or messages that violate CAN-SPAM, GDPR/ePrivacy, CASL, or any other applicable rule in the recipient’s jurisdiction.
  • Send email without a valid, working unsubscribe mechanism or without honoring opt-out requests promptly.
  • Misrepresent your identity, forge headers, use deceptive subject lines, or impersonate another person or organization.
  • Send phishing, malware, harassment, hate speech, or otherwise unlawful content.
  • Upload contact lists you have no lawful basis to email, or purchased lists that were collected without consent where consent is required.
  • Attempt to circumvent rate limits, sending caps, warm-up ramps, suppression lists, or provider policies.
  • Probe, scan, or attack the service or the infrastructure it runs on.

We may suspend or terminate accounts that violate this section, and we may pause a sending account automatically when bounce or complaint rates indicate abuse.

4. Gmail and third-party integrations

  • Connecting Gmail is optional and always requires your explicit consent on Google’s own screen. SEND FORGE acts strictly on your instructions.
  • SEND FORGE requests only send, compose/draft, read (for reply and bounce detection), and basic profile scopes. It never requests permanent-deletion access and cannot delete your mail.
  • You may revoke access at any time from within the app or from your Google Account permissions page. Revocation stops all Gmail sending immediately.
  • Your use of Gmail also remains subject to Google’s own terms and Gmail sending limits. You are responsible for complying with them.
  • The same applies to Resend, your SMTP provider, and any AI assistant you connect over MCP: those connections act as you and within your existing permissions.

5. Your content

You retain ownership of your leads, templates, campaigns, and messages. You grant us only the limited rights needed to host, process, and transmit that content in order to operate the service for you. You represent that you have the right to use and email the contact data you upload.

6. Security and availability

We operate on managed infrastructure with TLS in transit, encryption at rest, Postgres Row Level Security on every table, role-based access enforced server-side, encrypted storage of sending credentials, and per-workspace audit logging. We aim for high availability but do not guarantee uninterrupted service. Report suspected vulnerabilities to developers.skymium@gmail.com; please do not publicly disclose until we have had a reasonable chance to fix the issue.

7. Open source

The SEND FORGE codebase is released as open source. Nothing in these terms restricts your rights under that license with respect to the code itself. These terms govern the hosted service, not your use of the source code, and the open-source license’s warranty disclaimers apply to the code.

8. Fees

Where paid plans are offered, pricing and billing terms are shown at checkout. Third-party costs (email provider, AI usage, domains) are yours and are billed by those providers.

9. Termination

You may stop using the service and delete your workspace at any time. We may suspend or terminate access for violations of these terms, legal requirements, or risk to the platform’s deliverability and safety. On termination, your data is deleted per the retention section of the Privacy Policy.

10. Disclaimers and liability

The service is provided “as is” without warranties of any kind, including merchantability, fitness for a particular purpose, deliverability outcomes, or non-infringement. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total liability is limited to the amount you paid for the service in the 12 months before the claim.

11. Indemnity

You will indemnify us against claims arising from your content, your contact lists, or your use of the service in violation of these terms or applicable law.

12. Changes and contact

We may update these terms; material changes will be announced in-app before taking effect. Continued use after the effective date means acceptance. Questions: developers.skymium@gmail.com.
